Apple sotto accusa: numerose violazioni delle norme di garanzia

Da qualche anno, una nuova e tremenda malattia sta mietendo vittime in tutto il mondo occidentale. Gli studiosi la chiamano sindrome da “mela morsicata”, per tutti comunque è la dipendenza da Apple. Negozi presi d’assalto, centinaia di euro spesi a cuor leggero e lodi infinite di prodotti e servizi, sono questi i sintomi più evidenti.

Tuttavia, anche la mela più splendente e sana del mondo ha i suoi piccoli scheletri nell’armadio.

Ma procediamo con ordine. Sabato pomeriggio, un ragazzo affetto da chiara dipendenza da mela, si è recato in un uno dei tanti Apple Store presenti in Italia. Verificato il problema, la batteria ormai collassata dell’IPhone5, ha firmato il consenso al lavoro, fornendo tra gli altri dati anche il proprio indirizzo mail per ricevere la garanzia. Pochi minuti di attesa e l’IPhone è rinato.

Fin qui nulla di sconvolgente, o comunque niente che vada contro il mito della perfezione di Apple.

Ma la gioia è durata solo il tempo del viaggio di ritorno verso casa. Acceso il PC, il nostro eroe si è imbattuto nella mail dell’Apple Store: “Grazie per averci scelto. Ecco uno copia del tuo registro di assistenza” con all’interno una piccola clausola “Accetto che i prodotti in riparazione potrebbero essere sostituiti con prodotti ricondizionati di tipo equivalente e che le riparazioni possono essere effettuate con componenti ricondizionati“.

Ebbene sì, la Apple ha risolto il problema piazzando una batteria già usata, con buona pace di tutte le norme relative alla garanzia.

Molti risponderanno che si trattava di un componente “ricondizionato”, che non c’è niente di male a utilizzare ricambi ancora validi e che la fiducia verso la azienda californiana non può basarsi su cose del genere.

Ma purtroppo il discorso è ben diverso.

Marco Pierani, responsabile relazioni esterne di Altroconsumo, spiega a laRepubblica che la Apple non avrebbe dovuto neanche “affacciare la possibilità di riparare lo smartphone con una batteria riciclata. In questo modo ha violato sia la normativa italiana (codice del consumo, articolo 130) che quella europea” e aggiunge “Si lede la garanzia e il consumatore è beffato perché la batteria ricondizionata non ha lo stesso valore della nuova, al punto che la legge le attribuisce un solo anno di garanzia, anziché due”.

A ben vedere, la Apple ha già ricevuto una sanzione dall’Antitrust per questi “inconvenienti” di garanzia.

Ma allora una cura è davvero possibile? I soggetti affetti da dipendenza da mela morsicata possono sperare e credere in una guarigione? Chi può dirlo. Appuntamento rimandato alla prossima caduta degli Dei.
